Terms and Conditions.


Blue Red Blue Training Services Southwest Ltd training shall comply with the requirements laid down by AITT (Association Industrial Truck Trainers) & ITSSAR (Independent Training Standard Scheme & Register) and in accordance with HSE legislation.


Blue Red Blue Training Services Southwest Ltd reserves the right to cancel training in the event the customer’s personnel, site and/or equipment do not meet the necessary requirements laid down in the specific training scheme operations manual and/or the Health and Safety at Work Act 1974.

In the event of such a cancellation the customer may be charged the full course fee.


We reserve the right to amend these terms from time to time, deemed to be an acceptance of these terms and conditions, and will lead to a binding contract between the parties.


Bookings will only be accepted and confirmed by receipt of a completed training booking form with Purchase Order Number, which we deem as confirmation of the course being booked.


All course fees must be paid 14 days prior to training commencement unless otherwise agreed in writing.


Payment can be made by via BACS online.


Certificates will not be issued until payment is made in full.


If payment has not been received prior to the training, it will be deemed that you do not wish to proceed with your booking and the course will not take place.


All fees quoted are excluding VAT.


The Customer is responsible for ensuring that all trainees are both physically and mentally fit to

attend training.


Trainees, in addition, it is the responsibilities of each individual to take appropriate medical advice as to whether they are fit to participate in the training.

Trainees must be capable of recognising potential hazards and of understanding the limitations of both

personnel and equipment.


Training will take place using the English language.


The trainer reserves the right refuse to train any delegate who does not meet the minimum standard required to attend the course. Should a course have to be cancelled due to a trainee showing symptoms of Covid19, then the full course fee will be payable.


The Customer is responsible for ensuring that all trainees are equipped with the necessary personal protective equipment and clothing prior to training commencement and that they have been professionally trained in its use, limitations and maintenance requirements. Requirements will be detailed in the joining instructions.


All trainees must be a minimum of 16 years old at the commencement of training,and a risk assessment under Management of Health & Safety at Work Regulations 1999, Regulation 3 to be made due to the age of the trainee if under 18.


All machines supplied by customers for training and assessments must have evidence of current LOLER Certificate, to prove an examination has taken place within the agreed time period.


Where training is to be conducted at the customer’s premises, the customer is responsible for ensuring that all on-site resources, training room, seating, temperature controls, refreshment arrangements, toilet facilities, practical training area and machines are adequate for training purposes.


All trainees are required to achieve the pass marks laid down in the relevant training scheme operations manual. Failure to pass a theory test will prevent a trainee from progressing to the practical element of the course. In the event of a trainee failing to pass or complete the course the customer will be charged with the full course fee.


In the event that the customer requests a cancellation of a scheduled course by email (phone cancellations will not be accepted; this protects the customer and the provider) the following charges will apply:

Failure of a trainee(s) to attend will be considered as a cancellation without notice and as such the customer will be charged with the full course fee no refunds will be given.


Blue Red Blue Training Services Southwest Ltd reserves the right to cancel or alter the dates of provision of service, the charges and the individual(s) providing the service.


Blue Red Blue Training Services Southwest Ltd shall not be liable for any failure to perform any obligation here under when prevented from doing so by an act of God, war, fire, riot or civil disturbance, snow or flood, strikes or other labour dispute, or any other conditions beyond the control of Blue Red Blue Training Services Southwest Ltd.


Blue Red Blue Training Services Southwest Ltd accepts no liability of any kind for any loss or damage to property or for any other loss, including loss of earnings, profits or injury to persons arising directly or indirectly from any act or omissions of Blue Red Blue Training Services Southwest Ltd irrespective of how this loss/damage was caused.


If a breakdown between Client and Blue Red Blue Training Services Southwest Ltd occurs and you terminate the contract, you will still be required to pay all fees up to the time of the termination of contract.


Cancellation of training over 6 days prior to training commencement. Blue Red Blue Training Services Southwest Ltd reserves the right to offer alternative dates and no refund will be paid.


All terms and conditions are subject to change.


Certification remains the property of Blue Red Blue Training Services Southwest Ltd until the full fee has been price agreed has been paid together with any interest and charges.

These terms shall be governed by English law and be within the exclusive jurisdiction of the English Courts.
