LOLER 98 – DEALS SPECIFICALLY WITH LIFTING OPERATIONS AND LIFTING EQUIPMENT AND AIMS TO REDUCE RISK TO H&S FROM LIFTING EQUIPMENT AT WORK.
While employees do not have specific duties under LOLER 98 they do have duties under MHAWR and HASAWA to comply with and use equipment as instructed.
•LOLER REQUIRES THAT IN USING LIFTING EQUIPMENT IT MUST BE:
•SUFFICIENTLY STRONG, STABLE AND SUITABLE FOR THE PROPOSED USE.
•SIMILARLY THE LOAD AND ANYTHING ATTACHED (TIMBER PALLETS, LIFTING POINTS) MUST ALSO BE SUITABLE.
•POSITIONED OR INSTALLED TO PREVENT THE RISK OF INJURY, FROM THE EQUIPMENT OR LOAD FALLING AND STRIKING PEOPLE.
LOLER 1998 Regulation 8 states:
All lifts shall be:
Properly planned by a competent person
The plan should ensure that the lifting equipment remains safe for the range of lifting operations for which the equipment might be used .(Pre-Start Inspections)
Carried out in a safe manner
Carried out to comply with the employers recommendation.
Regulation 9 States:
Lifting equipment needs to be inspected:
Exposed to conditions liable to cause deterioration
After an exceptional circumstance (accident)•In most cases every 12 months unless:
Forklift trucks fitted or using attachments (6 months)
Forklift trucks used for more than 40hrs a week (6 months)
Equipment used for lifting people (6 months)
If a truck does not have an in-date LOLER then it should not be used!
