Terms and Conditions


No variation can be made to these terms without the written consent of Blue Red Blue Training Services Southwest Ltd
The acceptance of attendance on a training course with Blue Red Blue Training Services Southwest Ltd by you the client shall be:
 As a client of Blue Red Blue Training Services Southwest Ltd, you agree to the terms and conditions set out as below:
We reserve the right to amend these terms from time to time.

Deemed to be an acceptance of these terms and conditions, and will lead to a binding contract between the parties.
As our client you agree to provide any information required for Blue Red Blue Training Services Southwest Ltd to carry out the registration process relating to training.

This information will be required within an agreed timescale.

Blue Red Blue Training Services Southwest Ltd reserves the right to amend any accidental error or omission without liability.

 Health and Safety
The client accepts responsibility under the Health and Safety at Work Act 1974 and will not contravene any duty or inspection imposed by law.

We reserve the right to expel individuals from any training for breach of Health and safety or by displaying dangerous acts, with no regard for other student’s safety without liability, at our absolute discretion, their behaviour is inconsistent with our reputation or conducive to the delivery of training.

Each individual must inform us of any medical condition/s which may affect them or others whilst on course and a forklift medical must have been attended, and Blue Red Blue Training Services Southwest Ltd undertake that all such information will be kept in confidence.

In addition, it is the responsibilities of each individual to take appropriate medical advice as to whether they are fit to participate in the training.

The client will accept full responsibility for all statutory requirements placed upon a client by the relevant governing bodies and acts including the L117, PUWER Regulations 1998, LOLER Regulations 1998, the maintenance and safety of the lifting equipment, protective clothing and all insurances including any loss, injury or damage sustained during the course of training or arising out of the neglect and/or breach of statutory duty by the client or in any other way.

Trainees must adhere to all health and safety instructions given by the Course Organiser/Trainer/Instructor/Assessor during their time with us.

The Trainer/Instructor/Assessor have the right to finish a course early if conditions are deemed to be unsafe.

Blue Red Blue Training Services Southwest Ltd cannot be held liable for any loss or damage caused by Force Majeure.

Blue Red Blue Training Services Southwest Ltd accepts no liability of any kind for any loss or damage to property or for any other loss, including loss of earnings, profits or injury to persons arising directly or indirectly from any act or omissions of Blue Red Blue Training Services Southwest Ltd irrespective of how this loss/damage was caused.

Payment and Cancellation.
Payments

All accounts are subject to the following terms of payment:

We accept BACs payments. Any cheque payment will be agreed before proceeding.

All invoices are to be paid no later then 28 days after commencement of training, unless otherwise agreed in writing.

Once an invoice has had the PO number confirmed and the training has been agreed by the client,the client will be liable for the payment unless the training has been cancelled and the cancellation terms have been followed.

Certificates will not be issued until payment is made in full.

Cancelling services: Your right to cancel:

You have 14 days from entering into a service contract in which you can cancel it.

Blue Red Blue Training Services Southwest Ltd will not start providing the service before the 14 day cancellation period has ended, unless you have requested this.

In this instance you will still have the right to cancel, but you must pay for the value of the service that is provided up to the point you cancel.

The right to cancel can be lost during the cancellation period if the service is provided in full before the 14 days elapses.

Cancellation.

Blue Red Blue Training Services Southwest Ltd have the following cancellation policy: 50% of course fee if cancelled with more than 7 days but less than 10 days’ notice.100% of course fee if cancelled with 7 days’ notice or less.

The client will not reduce any payment from the agreed price, all deductions and refunds will be made by Blue Red Blue Training Services Southwest Ltd, in an agreed time scale.

If we arrive on the day for training and the training has been cancelled by the client we will require full payment.
Any courses confirmed in writing & unattended,a full payment will be required in full.

Certification remains the property of Blue Red Blue Training Services Southwest Ltd until the full fee has been paid together with any interest and charges.

These terms shall be governed by English law and be within the exclusive jurisdiction of the English courts.
